Terms of Sale

1. Purpose and scope

These Terms of Sale (hereinafter "Terms") govern all sales concluded between AP FRANCE, a SASU with capital of 1,000 euros, registered with the Nanterre Trade and Companies Register under SIREN number 802 005 108, whose registered office is at 49 bd du Lycée 92170 Vanves (hereinafter "the Seller"), and any individual or legal entity making a purchase on the assistantprive.io platform (hereinafter "the Customer").

Any order implies full and unreserved acceptance of these Terms.

2. Description of services

The Seller offers an administrative concierge service for foreign nationals residing in or relocating to France. Depending on the plan subscribed, the service includes in particular: support with everyday administrative processes (monthly subscription), support for active entrepreneurs (annual subscription), installation support in France under the Passeport Talent scheme (annual pack), one-time support for a change of status, and expert case review. Add-ons may be offered at checkout (business plan, company incorporation, bank account opening).

The details of the services included in each plan are shown on the order page at the time of subscription.

The Seller is neither a law firm nor an accounting firm; it provides administrative support and does not deliver regulated legal or accounting advice. Decisions relating to visas and residence permits fall exclusively within the remit of the competent French authorities.

3. Price and payment terms

Prices are shown in euros, all taxes included (TTC), including VAT at the rate applicable on the order date.

Payment is due immediately upon ordering. It is made by credit card via our secure payment provider. The Seller does not store any banking data.

For monthly subscriptions, renewal is automatic unless cancelled before the due date, as described in Article 5. For annual subscriptions and packs, renewal only occurs with the Customer's express consent.

The amount of a case review already paid for is deductible from the price of a subsequently subscribed Change-of-Status or Passeport Talent plan, under the conditions shown at checkout.

4. Access to the service

Access to the platform and handling of the case open immediately after payment is validated. The Customer acknowledges that the service is provided without delay from confirmation of their order.

The Customer undertakes to provide accurate, complete, and up-to-date information and documents. The Seller cannot be held liable for the consequences of incorrect information or missing documents attributable to the Customer.

5. Duration and termination

For monthly subscriptions, the subscription renews automatically at each due date for an identical term, unless cancelled. The Customer may cancel at any time from their personal account; cancellation takes effect at the end of the current period and no pro-rata refund is made.

For annual subscriptions and packs, the term is twelve months from subscription. At the end of term, renewal is offered to the Customer and only occurs with their express consent.

For one-time services (notably change of status and case review), the contract ends once the service is performed, with no automatic renewal.

6. Right of withdrawal

Under Article L221-18 of the French Consumer Code, consumers have 14 days to exercise their right of withdrawal without giving a reason, from the conclusion of the contract.

By checking the dedicated box when ordering, the Customer expressly requests immediate performance of the service before the withdrawal period expires.

Under Article L221-28 of the French Consumer Code, the right of withdrawal can no longer be exercised for a service fully performed before the end of the withdrawal period with the consumer's prior express consent and express waiver of the right of withdrawal. If the Customer withdraws while performance has begun but is not complete, they remain liable, under Article L221-25, for the amount corresponding to the service provided up to the point they communicate their decision.

7. Liability

The Seller is bound by a best-efforts obligation. It undertakes to use all necessary means to ensure the quality of support and the availability of the platform. It cannot be held liable for interruptions due to external causes (force majeure, hosting provider failure, etc.).

The outcome of administrative processes (issuance of a visa, residence permit, social benefit, etc.) depends exclusively on the competent authorities. The Seller in no way guarantees a favorable decision.

8. Protection of personal data

Personal data collected when ordering and performing the service is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act. It is necessary for managing the order, providing the service, and billing. Documents entrusted by the Customer are used only for the processes they have expressly entrusted to the Seller.

The Customer has the right to access, rectify, erase, and port their data, as well as the right to object to and restrict its processing. These rights may be exercised by contacting contact@assistantprive.io.

9. Intellectual property

All content on the platform (text, guides, interfaces, software) is the exclusive property of the Seller or its partners and is protected by intellectual property law. Any unauthorized reproduction or use is prohibited.

10. Referral and affiliate program

The Seller may offer two distinct referral schemes allowing Customers and third-party partners to obtain pricing benefits when subscribing to a service.

10.1 Customer-to-customer referral

Any Customer with an active account may share a personal referral code. When a new Customer (hereinafter "the Referee") uses this code on their first eligible order, the following benefits apply:

  • The Referee receives an immediate discount on the total (TTC) amount of their first order, the amount of which varies by product subscribed and is shown at checkout.
  • The referrer receives a credit applied to their account once the Referee's order is validated and paid.

Accumulated credits are valid for 365 days from the date they are granted. They can be used for a future eligible purchase and are neither refundable nor convertible to cash.

The discount granted to the Referee and any credits applied by the referrer may not together exceed 50% of the total (TTC) price of the order. The referral discount takes priority in applying this cap.

10.2 Partner program (commercial referral)

Third parties previously approved by the Seller (hereinafter "Partners") may take part in a commercial referral program. Joining this program is subject to an application process and the Seller's express acceptance.

A Partner who refers a new eligible Customer via their dedicated code may receive a commission calculated on the total (TTC) amount of that Customer's first order, the amount of which varies by product subscribed. Payment is made monthly, provided the order is definitively paid and the legal 14-day withdrawal period has expired.

A Referee referred by a Partner also receives an immediate discount on their first eligible order, under the same capping conditions as in 10.1.

10.3 Common provisions

The benefits (discount, credit, commission) apply only to the Referee's first order for each eligible product. Subscription renewals are billed at the applicable full rate, with no automatic application of referral benefits.

The Seller reserves the right to modify or suspend the referral programs at any time, without notice. Codes already used and credits already granted remain valid until expiry or use. Any abuse, fraud, or circumvention attempt (self-referral, multiple accounts, etc.) results in the cancellation of benefits and may lead to suspension of the account concerned.

11. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the Customer may refer the matter to a consumer mediator (Art. L612-1 French Consumer Code). Failing that, the competent courts are those of Nanterre.
